Integrated Asset Protection for Families & Business Owners in Williamsburg, Virginia
Effective asset protection considers planning your estate, future care needs, and business risks together. At J. S. Burton, P.L.C., we incorporate asset protection into broader estate plans that address liability during life and the transfer of wealth after death. We align legal tools with how you own property, earn income, operate a business, and intend to support future generations.
We serve individuals, families, professionals, and business owners throughout Williamsburg, the Historic Triangle, and the Virginia Peninsula. Our boutique law practice has more than two decades of experience in estate planning, asset protection, elder law, business law, trust and probate administration, and charitable entity formation. John S. Burton founded our firm in 2005 and has practiced estate planning, asset protection, elder law, and business law since 2003. He is a Certified Estate Planner and a Trust and Estate Practitioner, a professional designation issued through the Society of Trust and Estate Practitioners.

Virginia Asset Protection Tools & Their Limits
Asset protection planning may draw from several legal and financial tools, but no single option addresses every risk. The appropriate combination depends on asset ownership, existing obligations, potential liabilities, and whether planning begins before a creditor claim arises.
Important distinctions among common Virginia planning tools include:
- Qualified Self-Settled Spendthrift Trust: Virginia authorizes this form of domestic asset protection trust. It must be irrevocable, include a spendthrift clause restricting a beneficiary’s ability to transfer an interest, and have an independent qualified trustee based in Virginia. The settlor, meaning the person who establishes and funds the trust, may remain a discretionary beneficiary. Assets may receive protection from most future creditors when all statutory requirements are satisfied, while existing creditors generally have five years to challenge a transfer.
- Revocable Living Trust: A revocable living trust can govern asset management and distribution, but it doesn’t protect the settlor’s property from the settlor’s creditors during life. Because the settlor retains control and can revoke the trust, its assets generally remain available to satisfy personal obligations.
- Homestead Exemption: Virginia’s homestead exemption can protect up to $50,000 of equity in a principal residence, plus $500 for each dependent. Availability depends on applicable eligibility and filing requirements, so the exemption shouldn’t be assumed without reviewing the circumstances.
Liability insurance addresses claims covered by a policy’s language and limits. Estate and business planning addresses ownership, decision-making authority, and asset transfers. We evaluate these considerations together as part of a coordinated plan.
Medicaid Planning for Future Care Costs in Virginia
Long-term care expenses can change how a family approaches asset protection. We help clients plan for these costs, including Medicaid qualification strategies intended to preserve assets when governing rules permit. Eligibility isn’t automatic, and timing matters because Virginia applies a 60-month look-back period to Medicaid planning.
During that period, transfers for less than fair market value can create a penalty period for nursing home or waiver-based Medicaid coverage. For 2026, Virginia generally limits countable assets to $2,000 for a single applicant and $3,000 when both spouses apply. The 2026 home equity limit is $752,000 for a residence to remain exempt for Medicaid eligibility, subject to other applicable requirements.
We typically include a durable power of attorney and an advance medical directive in an asset-protection-oriented estate plan. A durable power of attorney authorizes a chosen person to handle specified financial affairs if needed. An advance medical directive records health care instructions and identifies who can make medical decisions when the individual can’t communicate them.
Asset Protection for Williamsburg Business Owners & Professionals
Personal wealth and business risk can overlap when ownership structures, contractual obligations, personal guarantees, or insurance coverage don’t align with a client’s exposure. We work with clients to separate personal and business assets through planning tailored to their circumstances. This approach considers both the business interest and the owner’s estate plan.
We regularly represent lawyers, doctors, other licensed professionals, and business owners facing potential malpractice, breach of fiduciary duty, and negligence claims. Business entity structuring can form one part of the analysis, while liability insurance may respond to claims covered by the policy. Estate planning also determines who has authority over assets and how ownership interests may transfer.
Planning is most effective before a creditor claim or care crisis develops. Once a claim exists, applicable law may restrict or expose transfers to challenge. Addressing foreseeable risks early provides more time to evaluate lawful options without relying on a rushed response.
