Planning ahead allows families to address who may make decisions during incapacity, which resources could pay for care, and whether existing estate documents still support their goals. The plan may need to be revisited as health, relationships, assets, or care settings change.

Virginia Medicaid Planning for Long-Term Care
Virginia Medicaid may help qualified individuals pay for certain care services, but eligibility depends on current program rules and the applicant’s personal and financial circumstances. Income, resources, prior transfers, marital status, documentation, and the requested level of care may all require analysis. Because applicable standards can change, planning should rely on the rules in effect at the time of application.
We evaluate lawful ways to restructure assets and income in an effort to satisfy eligibility requirements while preserving as much as the law permits for the family. Depending on the circumstances, this may involve spend-down strategies, allowable purchases, income conversion, or qualifying trust vehicles. Careful sequencing matters because an ill-timed transfer or trust change can affect eligibility or result in a transfer penalty.
Medicaid Application Support
A Medicaid application must be supported by complete, consistent financial records. How Medicaid Estate Recovery May Affect an Estate
Through Medicaid estate recovery, Virginia may seek repayment after a recipient’s death for certain benefits paid on that person’s behalf. Recovery may apply to certain payments for a member who was 55 or older. The property subject to a claim and the amount pursued depend on the governing rules and the individual estate.
Virginia’s rules include protections involving a surviving spouse, a child younger than 21, or a blind or disabled child. Undue-hardship provisions and special treatment for certain long-term care partnership policy resources may also apply. We consider estate recovery alongside property ownership, benefits eligibility, family circumstances, and the broader estate plan.
Planning for Care at Home & in the Community
Nursing facility care isn’t the only potential setting. Subject to eligibility, program requirements, and service availability, some people may receive care at home or through community-based programs. We help clients assess possible connections to Virginia’s Commonwealth Coordinated Care Plus waiver and programs administered by the Virginia Department for Aging and Rehabilitative Services.
Veterans Aid and Attendance may also be part of the funding analysis for qualifying wartime veterans and surviving spouses.
